This acceptable use policy together with terms and conditions set out the terms between you and us under which you may access our website www.labelresizer.com (our site) and, where you are a member or guest of Label Resizer, use the services which are available via our site. This acceptable use policy applies to all members and guests of the Label Resizer, and to all other visitors to, our site.

Your use of our site means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement the website use agreement. If you are invited to become a member or guest of the Label Resizer you accept this acceptable use policy as part of the application process.

The date on which this acceptable use policy was first published is 26 July 2020.

This acceptable use policy applies to all visitors to and users of this site.

Prohibited Uses

You may use our site only for lawful purposes and as permitted by our policies from time to time. You may not use our site:

  • a. In any way that breaches any applicable local, national or international law or regulation.
  • b. In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • c. For the purpose of harming or attempting to harm minors in any way.
  • d. To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • e. To knowingly transmit any data, send or upload any material that are not related with our service or that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  • f. Accessing and using our site from multiple devices at the same time with the same member credential.
  • g. Sharing account credentials with other individuals and using other member’s credentials to access our website.
  • h. Selling all or part of the membership rights including selling “label resizing service” to the 3rd party individuals without written permission from Label Resizer.
  • i. Unlimited User’s Fair Policy: Label Resizer provides unlimited subscription model to its members via our website, browser extension, and API service. The fair usage policy applied to our Unlimited Plan sets a cap on what may be used, intended to allow normal usage but prevent what is considered excessive. Therefore, our members are expected to avoid usage which is continually excessive, unfair and affects other users’ experiences using Label Resizer services. To this end, we may request additional payment starting from the next billing cycle, or restrict the usage of service, or deactivate the account in the following cases:
    • Sudden burst of increase of usage at one or many locations
    • Using the service to resize 200,000 or more products labels and 20,000 or more shipping labels in a month
  • j. Unlimited User’s Fair Policy for Grandfathered and Promotional Members: Grandfathered and promotional members are expected to use a fair amount of service. We may request payment of the current package pricing starting from the next billing cycle, or restrict or deactivate the account if:
    • Grandfathered and promotional members use 3 times or more than the usage limit’s of the package that the member would have been with their current monthly or yearly payment.

You also agree:

  • a. Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of the website use agreement.
  • b. Not to access without authority, interfere with, damage or disrupt any part of our site.
  • c. Not to interfere with any equipment or network on which our site is stored.
  • d. Not to interfere with any software used in the provision of our site.
  • e. Not to interfere with any equipment or network or software owned or used by any third party.

Suspension and Termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the website use agreement and may result in all or any of the following actions:

  • a. Immediate, temporary or permanent withdrawal of your right to use our site or some or all of the services available through our site.
  • b. Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  • c. Issue of a warning to you.
  • d. Immediate, temporary or permanent termination of your membership.
  • e. Legal proceedings against you for reimbursement of all costs on an indemnity basis resulting from the breach.
  • f. Further legal action against you.
  • g. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Changes to the Acceptable Use Policy

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site.

Enforceability

The enforceability rules stated in the Terms and Conditions of Label Resizer shall apply on the disputes related with this policy.

General

Any failure or delay by us in enforcing compliance with this acceptable use policy shall not be a waiver of that or any other provision of these terms, membership terms or acceptable use policy.

If any provisions of this acceptable use policy is unlawful, void or for any reason unenforceable then that provision shall be deemed sever-able and shall not affect the validity and enforceability of the remaining terms.

The headings in this acceptable use policy are for reference purposes only and do not limit the scope of extent of the membership terms.

The provisions of this section will remain in force after termination.
